A lawyer accused of gang raping three teens at his bucks party weekend gave a “fabricated ” account of the sexual encounters, a court has been told.

A court has been told that the man who is accused of gang raping three teenagers inside an Airbnb at his bucks party gave a "fanciful" account of the sexual encounters that was "not believable."


Andrew David, 30, brothers Maurice Hawell, 30, and Marius Hawell, 22, and Andrew David, 30, have all pleaded not guilty to the charges of aggravated sexual touching, aggravated sexual assault in a group setting, and attempting to commit aggravated sexual assault in a group setting.


When they allegedly sexually assaulted three women, the men were having a bucks party in Newcastle on a weekend in February 2022 to celebrate Maurice's upcoming wedding.


The threesome have confronted a weeks-in lengthy preliminary in the NSW Local Court over the supposed joint criminal undertaking.


In his end address to the Court on Monday, Crown examiner Craig Evans said the jury ought to ignore the "whimsical" proof given by Maurice during the preliminary.


"It's not believable. It's not credible. It's not reliable," he said.


In his record of the Saturday night, Maurice said he moved toward a 19-year-old Female

in the city and she consented to engage in sexual relations with him before they entered the Airbnb he had rented.


Mr Evans said the evidence was “totally inconsistent with the contemporaneous evidence”, including CCTV footage and texts the woman had sent to a friend that said she was “in danger and needed help”.


The night before, the court was told Maurice had used a fake name when he invited an 18-year-old back to the Airbnb that had been leased for his bucks party.


He advised the jury that the 18-year-old in the end said OK and participated in consensual sexual activities with Mr David, yet she then needed to push him off on the grounds that he didn't pay attention to her telling him to stop injuring her breasts.


Mr David has not been accused of any offense over the injury to her breasts, yet Mr Evans said it showed his perspective before the supposed assault.
